These Terms of Service ("Terms") govern your use of the website, services, and products provided by American Dream Custom Pools ("Company," "we," "us," or "our"). These Terms apply to all customers, website visitors, and parties engaging with our pool construction, renovation, maintenance, and repair services.

1. Acceptance of Terms

By accessing and using this website, obtaining a quote, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you should not use our services or website.

We reserve the right to modify these Terms at any time. Continued use of our services following any changes constitutes your acceptance of the updated Terms.

2. Services Description

American Dream Custom Pools provides the following services:

• Custom pool construction and design
• Pool renovation and remodeling
• Pool maintenance and service
• Pool repair and equipment replacement
• Consultation and design services

All services are provided in the Nashville, Tennessee area and surrounding Middle Tennessee communities. Specific services and their availability will be discussed during your initial consultation.

3. Quotes and Pricing

All quotes and estimates provided are valid for thirty (30) days from the date of issuance unless otherwise specified. Quotes are based on the information provided during consultation and may be subject to change if project specifications change.

Prices are subject to change without notice. Additional costs may apply if unexpected conditions are discovered during the project, including but not limited to underground utilities, soil conditions, or structural issues. Any additional costs will be communicated to you before work continues, and we will not proceed without your approval.

All pricing is in US dollars and does not include applicable taxes unless explicitly stated in the quote.

4. Payment Terms

Payment terms will be specified in your project proposal and contract. Standard payment terms are:

• 50% deposit due upon contract signature to secure your project date
• Remaining balance due upon project completion

We accept payments via check, credit card, bank transfer, and financing options. Accounts not paid within fifteen (15) days of invoice may incur a 1.5% monthly interest charge. Unpaid accounts may be referred to a collection agency.

We reserve the right to suspend services if payment is not received according to the agreed-upon payment schedule.

5. Project Timeline

Project timelines provided in quotes and contracts are estimates and may be subject to delays due to weather, unexpected site conditions, material availability, or other circumstances beyond our control. We will keep you informed of any anticipated delays.

Customer delays in decision-making, approvals, or site access may extend the project timeline. Work performed outside of normal business hours (Monday-Friday, 8am-5pm) may incur additional charges.

6. Warranties

We warrant that:

• All work will be performed in a professional and workmanlike manner according to industry standards.
• All materials will be new unless otherwise agreed upon in writing.
• Construction work is warranted for one (1) year from the date of completion against defects in workmanship.

Equipment and material warranties are provided by the manufacturers. We will assist in processing warranty claims but are not responsible for manufacturer warranty coverage. Warranty coverage does not include normal wear and tear, improper maintenance, misuse, or damage from acts of God.

THESE WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AMERICAN DREAM CUSTOM POOLS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF AMERICAN DREAM CUSTOM POOLS FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID FOR THE SERVICES IN QUESTION.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

8. Intellectual Property

All content on our website, including designs, photographs, text, logos, and other materials, are the intellectual property of American Dream Custom Pools or our licensors. You may not reproduce, distribute, transmit, or display any content without our prior written permission.

Custom designs created for your project remain the intellectual property of American Dream Custom Pools unless a separate written agreement is signed transferring ownership. You have the right to use the completed pool project as built.

9. Cancellation Policy

Cancellations must be provided in writing to our company.

• Prior to Contract Execution: Full refund of any deposits or fees paid.
• Within 7 Days of Contract: 50% of initial deposit is refundable; 50% is retained to cover scheduling and planning costs.
• After Work Has Begun: All deposits are non-refundable. You are responsible for payment of all work performed to date plus any cancellation costs.

10. Governing Law

These Terms and any disputes arising out of or relating to our services shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflicts of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Davidson County, Tennessee.

11. Dispute Resolution

In the event of a dispute, the parties agree to attempt to resolve the matter through good faith negotiation before pursuing legal action. If negotiation fails, disputes may be resolved through binding arbitration or litigation as permitted by Tennessee law.

Any legal action or proceeding must be commenced within one (1) year after the cause of action arises, or it will be barred by statute of limitations.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify customers of any material changes via email or by posting on our website. Your continued use of our services following any changes constitutes your acceptance of the updated Terms.

For any ongoing or future projects, the Terms in effect at the time of your contract signing will govern that project.
